Immigration Procedure

The investor must complete the following steps, in order to become a permanent resident of the U.S.

1. Receive USCIS Approval

The investor must complete Form I-526 (Immigrant Petition by Alien Entrepreneur Form). This completed form, along with supporting documentation demonstrating the investment meets all EB-5 requirements, must then be submitted to U.S. Citizenship and Immigration Services (USCIS).

2. Conditional Permanent Resident

Once the investor has received Form I-526 approval, they may obtain conditional resident status by submitting Form I-485 (Application to Register Permanent Residence or Adjust Status) to USCIS. If residing outside the U.S., the investor must apply for an immigrant visa at a U.S. Consulate.

3. Termination of Conditional Green Card

Within 90 days of expiration of the conditional period, the investor should file a completed Form I-829 (Petition by Entrepreneur to Remove Conditions) to USCIS. In this form, the investor must demonstrate that the investment was sustained over the two-year conditional period and the required jobs were created. Once approved, the conditional status of the green card is lifted and permanent residency is granted.
